Having a smart phone myself, I understand how tempting it can be to check e-mail and text messages while driving, but as a Seattle wrongful death lawyer and Everett auto accident attorney I also understand the dangers of these bad habits. In recent months the texting while driving problem has been flooding the media and the legislature and nearly every state has made it illegal to text while driving, but still it continues to be a huge problem.

On Friday, December 3rd a 53-year-old woman was hit and killed while crossing the street in an accident police believe was caused by texting while driving. The accident happened at approximately 5 pm in Milwaukee when Linda Lee Zyduck crossed the street with her walker after exiting a bus. Zyduck was struck in the right-hand eastbound lane by a 19-year-old woman and was killed.

The driver claims to have not seen the pedestrian crossing the street before the fatal pedestrian accident. Upon investigation police discovered there were texts sent and received minutes before the fatal pedestrian accident. In fact, a partially completed text message remained on the phone. Though texting while driving appears to have played a role in this horrible fatal pedestrian accident it has not yet been confirmed as the reason behind the accident and is pending further investigation.

This horrible fatal pedestrian accident comes just days after a new law made texting while driving illegal. If it is determined that texting while driving contributed to this accident the driver could face a citation of up to $400 along with various other charges of negligent driving.

Texting while driving is a serious issue that is causing thousands of auto accidents every year. Though texting while driving is illegal in most states it still continues to be a big problem and the only way to end this fatal epidemic is by each of us choosing to be safe behind the wheel and not text while driving.
