Lawmakers Attempting to Fix Texting While Driving Loophole in Maryland | Seattle Car Accident Lawyer
It is now illegal in Maryland to send or write text messages or emails while you are driving. Yet there is a large loophole in the new law that may not prevent distracted driving or car accidents like it intends to. While it is illegal to send and write text messages, the law does not prevent drivers from reading texts and emails while driving on the state’s roads. What good does this do? This law does not do all that it should as reading texts is just as distracting as sending them. Some state officials believe that the law does not do enough to protect citizens from distracted drivers. It also provides a challenge to police officers attempting to give out tickets. When they see someone on their phones, how are they supposed to know if they are sending or reading a text? They can’t, and this makes it very difficult to give citations. Delegate James E. Malone Jr., D-Baltimore County, said “There are a lot of people now who communicate only through text messages. What we are trying to do is keep them from endangering the public while they do it.” The only way to protect the public is to ban not only sending texts and emails, but also from the just as distracting activity of reading texts and emails.
