Motorcycle Accident Leaves Two Injured | Seattle Personal Injury Lawyer

Yet another motorcycle accident caused serious injuries in Okanogan, Washington. Sandra A. Mena Tyree of Olympia, Washington suffered serious injuries to her face and eye and was transported to Harborview Medical Center in Seattle to treat her injuries.

Ms. Mena Tyree was a passenger on a motorcycle driven by Joe W. Tyree. Mr. Tyree was transported to Mid-Valley Hospital in Omak with minor injuries. The pair were on a 2008 Kawasaki 1600 which was towing a trailer. As the motocycle trailer combination entered a curve the driver lost control of the bike and the accident followed. Authorities indicated that excessive speed and faulty equipment were the causes of the accident.

This type of accident illustrates something that I often face in my practice. What happens when one spouse is at fault for an accident that injures the other spouse. Since Ms. Mena Tyree was a passenger on the motorcycle, and was not in control of the bike when the accident happened, it is likely that she was not at fault in any way for the accident. It is likely that the driver of the motorcycle, Mr. Tyree, was at fault for not maintaining a safe speed.

In cases like these, the injured spouse can bring a claim against the at-fault spouse’s insurance policy, assuming he had insurance. Believe it or not, this is fairly common. Sometimes, when the insurance company representing the at-fault spouse will not act reasonably, it becomes necessary for one spouse to file a lawsuit against the other spouse.
