Police In Atlanta Cite Texting While Driving As Cause For Wrongful Death Vehicular Homicide | Seattle Car Accident Attorney
Gwinnett police in Atlanta used texting while driving as the basis for a vehicular homicide charge yesterday in an auto accident wrongful death case. On October 30, Lori Reineke was driving her 2008 Ford Edge when she struck and killed a pedestrian, James Eaton III. While Reineke was neither impaired nor speeding, police say she was texting at the time of the wrongful death car accident. Reineke had a green light, and Eaton entered the crosswalk when the pedestrian sign said stop. While crossing when he had a red light was a contributing factor in the pedestrian accident, police also say that if Reineke had not been texting, the outcome would have been different. After much investigation of the October 30th wrongful death auto accident, Reineke was arrested last Friday. She was charged with vehicular homicide, reckless driving, failure to exercise due care and engaging in actions which distract from the safe operation of a motor vehicle (using her cell phone). Because of the recent movement to ban the use of cell phones while driving, Reineke’s lawyer claims that officials are ‘pushing the envelope and trying to establish a test case’ with Reineke. He also said that the allegations were baseless and that Reineke was not texting at the time of the accident. The lawyer said, “It was dark, it was rainy and she just didn’t see him in time. Obviously, this is a case in which they are pushing the envelope and trying to establish a test case.” Whether this woman truly was texting at the time of the accident or not, a wrongful death was the result. see news story link above. It is rerlated to Reineke case. I am ex boyfriend she was texting at time of accident. I am working with mobile service provider to action change that will eliminate texting/emailing while mobile phone is moving faster than 8 mph. I like your commentary and we have to make some significant nationwide changes quicky. this is worse than drunk driving.
