Serious Injury Sends Selah Boy to Harborview | Seattle Personal Injury Lawyer

On Friday, in Selah, Washington, a pickup truck hit an 8 year-old boy causing serious injuries. Initially, the boy was transported to Yakima Valley Memorial Hospital where he was in listed in critical condition. Today, the boy was transported to Harborview because his injuries were even more serious than originally thought.

Reports indicate that the boy ran out into the path of the oncoming pickup. The driver attempted to avoid the child, but unfortunately he was unable to avoid striking the boy. The child was conscious and speaking at the scene. It is believed that drugs and alcohol were not a factor in this accident.

This is a sad story where, at least from the early indications, it seems there are only victims and nobody to shoulder the blame. If, in fact, the driver of the truck was not speeding and was travelling down the road in a reasonable manner when the child ran out in front of him, then he is likely not liable for the injuries to the child. In a way, he is a victim as well, because I’m sure it will be difficult for him to drive again without thinking there is always a child about to jump out from behind a car.

In all likelihood there probably is some insurance coverage available to the child which would pay some of his medical bills, but since this is probably a no-fault accident, the boy will not be able to receive any compensation for his general damages, also known as pain and suffering.

I don’t know if there is anything that the driver of the truck could have done to avoid this accident, however, it is a good reminder for all of us to be extra vigilant when driving in residential neighborhoods. You never know when a child may dart out into the street.
