MT was a surveryor for a large construction company. He was gathering some equipment from his work van when the driver of a pickup truck fell asleep at the wheel from taking pain medication that was not prescribed to him. MT was unable to get out of the way and he was run over by the pickup and dragged approximately 20 feet. The accident caused a burst fracture of MT’s lumbar spine. MT was rushed to the hospital and the next day a two level lumbar fusion was performed. Because of his new physical limitations, MT was unable to go back to work at his old position and required retraining. The minimal insurance limits of the at fault driver were recovered as was the insurance policy limit for the company van that MT was using at the time of the injury resulting in a total recovery of $1.05 million for MT.
