What if the other driver is insured, but their insurance limits aren’t enough to cover my damages?

« Back to Frequently Asked Questions

The other part of UM coverage is Under Insured Motorist, or UIM. If you have UM then you also have UIM. UIM coverage kicks in when the person who injured you has insurance, but their insurance limits aren’t high enough to make you whole for your injuries, in other words, they are under insured.

In this case your UIM coverage steps in where the other person’s coverage runs out. Please note, however, that as with UM, your own insurance company will fight you tooth and nail on a UIM claim. It is critical that you talk to an experienced personal injury lawyer to be sure your rights are protected.
